SPRINGFIELD, Mass. -- Perimeter security solutions provider Universal Safety Response Inc. (USR), a Smith & Wesson company, has been awarded $154,000 by a federal district court in its trademark infringement lawsuit against SecureUSA Inc.
USR filed a lawsuit against perimeter defense product provider SecureUSA in May 2008 for infringement of the GRAB® trademark, which USR owns for its proprietary vehicle barrier systems. The lawsuit was filed in the U.S. District Court for the Southern District of New York.
During the case, the court noted there was "clear and convincing" evidence that SecureUSA unlawfully used the trademark and that the company had made no effort to comply with the court's previous orders prohibiting it from using the mark. As a result, the court ordered SecureUSA to pay USR's attorneys' fees and $30,000 in sanctions.
"We are very pleased with the decision of the court and the award of attorney's fees and sanctions," says USR President Matthew Gelfand. "We have made a significant investment in the development and marketing of our GRAB barrier systems, which are installed at many corporate sites and military bases throughout the United States. We will continue to vigorously enforce our intellectual property rights."
