A federal appeals court has let stand a previous jury decision that found that Universal Surveillance Systems Inc. infringed on a patent by Tyco Fire and Security’s Sensormatic Electronics Corp. Without comment, the United States Court of Appeals for the Federal Circuit upheld on Jan. 26 a June 2003 verdict that found that Universal’s UNIPRO anti-theft tag infringed on Sensormatic’s patent for its Supertag® anti-theft product.
Under the previous decision, Universal has paid damages to Tyco and can no longer sell the UNIPRO product.
“Tyco is strongly committed to continually improving its Sensormatic technology and to defending those improvements to the benefit of its customers,” said John Smith, the vice president/general manager of Tyco Fire and Security’s EAS/RFID business, in a statement. “This court decision helps ensure that we can continue to do so.”
